1. Description of Service
AdXApproval provides programmatic advertising monetization services, including but not limited to, facilitating access to Google Ad Manager (GAM), AdX, and Managed Account (MCM) partnerships for publishers. Our services aim to optimize ad revenue through advanced strategies such as dynamic floor pricing and header bidding integration.
2. Eligibility
By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. You must own or have the necessary rights to the websites and digital properties for which you seek our monetization services.
3. Account Registration and Security
To access certain features of our services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Publisher Obligations
As a publisher utilizing AdXApproval services, you agree to:
•Comply with all applicable laws, regulations, and third-party policies, including but not limited to Google AdSense Program Policies, Google Ad Manager Partner Guidelines, and any other relevant advertising network policies.
•Ensure that your website content is legal, ethical, and does not infringe upon the rights of any third party.
•Refrain from engaging in any fraudulent, deceptive, or artificial means to generate impressions, clicks, or conversions.
•Provide accurate and complete information regarding your website(s) and traffic sources.
•Understand that failure to comply with these obligations may result in the termination of services and forfeiture of earnings.
5. Fees and Payments
Details regarding service fees, revenue share models, payment schedules, and reporting will be outlined in a separate agreement or contract provided upon successful application and onboarding. AdXApproval reserves the right to modify its fee structure with prior notice.
6. Intellectual Property
All content, trademarks, service marks, and logos on the AdXApproval website are the property of AdXApproval or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from our website without our express written permission.
7. Disclaimer of Warranties
Our services are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. AdXApproval does not guarantee that the services will be uninterrupted, error-free, or that all defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by law, AdXApproval shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.
9. Indemnification
You agree to indemnify and hold harmless AdXApproval, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the services or your violation of these Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction, e.g., Bangladesh], without regard to its conflict of law principles.
